HIRING OF DOMESTIC WORKERS FROM THE PHILIPPINES

Pursuant to the revised UK immigration rules that took effect on 6 April 2012, only diplomats stationed in the UK are allowed to hire domestic workers from overseas.

As such, POLO will only verify employment contracts of domestic workers from the Philippines whose employers are diplomats stationed in the UK.

Moreover, under Philippine laws, domestic workers being hired for overseas employment must be at least 23 years  old.

Following are the requirements for verification:

A.     For Direct Hires: 

  1. Duly-accomplished POEA-prescribed Employment contract*, notarized by a UK solicitor and legalized by the UK Foreign and Commonwealth Office (FCO)
  2. Duly accomplished employer’s profile*
  3. Certified true copy of the data page of employer’s passport
  4. Certification from the employer’s Embassy or Consulate that s/he is a diplomatic staff
  5. Copy of the data page of the employee’s passport
  6. Copy of the employee’s visa or certificate of sponsorship (COS) details
  7. Letter request from employer to POEA requesting exemption from the No Direct Hiring Policy*

B.    For Agency Hires:

  1. Job Order (JO) issued by the employer to the Philippine Recruitment Agency, legalized by a UK solicitor and legalized by the UK Foreign Commonwealth Office (FCO)
  2. Special Power of Attorney (SPA)* issued by the employer to the Philippine Recruitment Agency, notarized by a UK solicitor and legalized by the UK Foreign Commonwealth Office (FCO)
  3. Duly accomplished POEA-prescribed Employment contract*, notarized by a UK solicitor and legalized by the UK Foreign and Commonwealth Office (FCO)
  4. Duly accomplished employer’s profile*
  5. Certified true copy of the data page of employer’s passport
  6. Copy of the data page of the employee’s passport
  7. Copy of the employee’s visa or certificate of sponsorship (COS) details

Procedure:

A.   Submit two (2) sets of the above documents (1 original and 1 photocopy)  to POLO at Building 6, Philippine Embassy, Suffolk Street, London SW1Y 4HG.  Office hours are from 9:00 am to 1:00 pm then 2:00 pm to 5:00 pm, Monday to Friday except on holidays.

B.   If found complete and in order, pay, in cash, to POLO the following verification fee/s: 

  1. For direct hire, verification fee of £14.00  for the employment contract .
  2. For agency hire and involving only 1 worker, £14.00 each for the employment contract,  JO, and SPA.
  3. For agency hire and involving more than 1 domestic worker, then payment for JO and SPA is £42.00 each. Individual employment contract is still at £14.00 each.
  4. The documents will then be processed and verified.
  5. Pay to the Philippine Embassy the authentication fee of £18.00 per document (i.e. employment contract, JO and SPA).
  6. Wait for release of documents.

For those transacting by post: 

  1. Payment/s by postal money order for verification fee/s should be made to “POLO-London.”
  2. Payment/s by postal money order for authentication fee/s should be made to “Philippine Embassy-London.”
  3. Enclose a self-addressed stamped envelope for mailing of documents back to sender. 

 

IMPORTANT INFORMATION FOR EMPLOYERS AND DOMESTIC WORKERS:

1. After POLO verification, the employer shall send all the documents to his/her prospective domestic worker in the Philippines.

2. These documents and other requirements need to be submitted to the Philippine Overseas Employment Administration (POEA) by the domestic worker or by the Philippine recruitment agency for processing and eventual issuance of the worker’s exit clearance or OEC (overseas employment certificate).

3. Among other documentary requirements required by the POEA for processing are as follows:

a. Medical certificate issued by a Department of Health (DOH)-accredited medical clinic 

b. Pre-Departure Orientation Seminar (PDOS) Certificate issued by POEA or any POEA-accredited PDOS provider 

Country Specific Pre-Departure Orientation Seminar (PDOS) is a whole day orientation to OFWs consisting of a comprehensive module on employment contract familiarization, profile of the country of destination, stages of the OFWs life, health and safety, airport procedures, government programs and services. 

c. Comprehensive Pre-Departure Education Program (CPDEP) certificate issued by the Overseas Workers Welfare Administration (OWWA) 

CPDEPis a 3 to 6-day live-out training for Household Service Workers (HSWs) consisting of language training, culture familiarization and stress management to prepare them for life overseas.

4. Only those domestic workers in possession of the exit clearance issued by the POEA will be allowed by Philippine Immigration authorities to leave the Philippines for their overseas employment.

5. Foreign employer of a Filipino domestic worker is kindly advised not to purchase an airplane ticket for his/her worker, until such time that worker is in actual possession of the exit clearance/OEC or when the worker can assure the employer that the issuance of his/her exit clearance/OEC is imminent.
